1. Overview
ETAAC Pest Control respects the intellectual property rights of others and expects users of etaac.org (the “Site”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998, codified at 17 U.S.C. § 512 (the “DMCA”), we respond promptly to clear notices of alleged copyright infringement that are reported to our designated copyright agent as described below.
This policy explains how copyright owners can notify us of material they believe infringes their rights, how people whose material has been removed can respond, and how we handle repeat infringers. It should be read together with our Copyright Notice and Terms & Conditions.
2. Before You Submit a Notice
Many concerns can be resolved informally. If you see an image or text on the Site that belongs to you and you simply do not wish it to appear here, or if a credit is missing or incorrect, you may email [email protected] with a link to the material and we will review it and, where appropriate, promptly remove it or correct the attribution. A formal DMCA notice is not required for us to act on a good-faith request.
Before submitting a formal notice, please consider whether the use may be authorized by a license (for example, a Creative Commons license under which the material was published) or may qualify as fair use under 17 U.S.C. § 107. Copyright owners are expected to consider fair use before sending a takedown notice.
3. Notice of Claimed Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that material on the Site infringes your copyright, please send a written notice to our designated agent. Under 17 U.S.C. § 512(c)(3), your notice must include substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed or, if multiple works are covered by a single notice, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, such as the specific URL(s) on the Site.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that do not substantially comply with these requirements may not be effective under the DMCA, although we may still contact you to obtain missing information. Please send only copyright notices to the agent below; other questions should go to [email protected]. Trademark concerns are not covered by the DMCA, but you may send them to the same email address and we will review them.
4. Designated Copyright Agent
Notices and counter-notifications should be sent to:
Copyright Agent, ETAAC Pest Control[Business mailing address]
Email: [email protected]
Telephone: (855) 987-5196
Email is the fastest way to reach our agent. Please include “DMCA Notice” or “DMCA Counter-Notification” in the subject line.
5. How We Respond to Notices
When we receive a notice that substantially complies with the DMCA, we will:
- acknowledge receipt, generally within two business days;
- review the notice and, where it is valid, expeditiously remove or disable access to the identified material, generally within five business days of receiving a complete notice;
- take reasonable steps to notify the person who provided the material (if it was provided by a user rather than by ETAAC Pest Control) that it has been removed, and provide a copy of the notice, which may include your contact information; and
- keep a record of the notice and the action taken.
Where material was published by ETAAC Pest Control itself, we will review the claim, check our records of the material’s source and license, and either remove the material or contact you to explain why we believe the use is authorized. These time frames are our goals and may vary depending on the complexity of the request.
6. Counter-Notification Procedure
If material you provided was removed or disabled and you believe in good faith that this was the result of a mistake or misidentification, you may send a counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), a counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which ETAAC Pest Control may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
When we receive a valid counter-notification, we will promptly forward a copy to the person who submitted the original notice and inform them that we will replace the removed material or cease disabling access to it in 10 business days. Unless our designated agent receives notice that the original complainant has filed an action seeking a court order to restrain the alleged infringement, we will restore the material not less than 10 and not more than 14 business days after receiving the counter-notification.
7. Misrepresentations (Section 512(f))
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner or ETAAC Pest Control as a result of the misrepresentation. If you are not sure whether material infringes your copyright, we suggest that you first contact an attorney.
8. Repeat Infringer Policy
In appropriate circumstances, ETAAC Pest Control will terminate the accounts or access of users who are repeat infringers. A repeat infringer is a person who has been the subject of more than one valid, uncontested infringement notice, or whose material has been found to be infringing by a court. We may also, at our discretion, limit access to the Site or remove content of any user who infringes the intellectual property rights of others, whether or not there is repeat infringement.
9. Image Credits and Third-Party Licenses
Some images on the Site, including photographs of insects, rodents and wildlife, are sourced from Wikimedia Commons and are used under the licenses stated by their authors on Wikimedia Commons, such as Creative Commons licenses or public domain dedications. Attribution for these images, including the author and license where required, is recorded in the Site’s media library and shown in image captions or credits. Our use of such images is subject to the terms of the applicable license, and those images are not owned by ETAAC Pest Control.
If you are the author of an image and believe it has been credited incorrectly, used outside the terms of its license, or you would like a credit changed, please contact us at [email protected] and we will correct or remove it promptly.
10. Changes to This Policy
We may update this DMCA Policy from time to time, including to reflect changes in the law or in our designated agent’s contact information. The “Last updated” date at the top of this page shows when it was last revised.
