1. Terms
By accessing this website at etaac.org (the “Site”), you agree to be bound by these Terms and Conditions of Use (the “Terms”), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site. The materials contained in this Site are protected by applicable copyright and trademark law.
In these Terms, “ETAAC Pest Control,” “we,” “us” and “our” refer to ETAAC Pest Control, and “you” and “your” refer to any person who uses the Site, requests a quote or books a service. These Terms apply together with our Privacy Policy, Cookie Policy, Refund & Cancellation Policy, Disclaimer and Copyright Notice, each of which is incorporated into these Terms by reference. You must be at least 18 years old and legally able to enter into contracts to book services through the Site.
2. Our Service and Independent Contractors
ETAAC Pest Control operates a nationwide network and referral service in the United States. We help customers request quotes, book service packages and arrange appointments with independent local pest control contractors who serve their area. Depending on the location and the service requested, the contractor that performs your work is an independently owned and operated business.
You understand and agree that:
- Contractors are independent businesses and are not employees, agents, partners or joint venturers of ETAAC Pest Control. Each contractor is responsible for its own personnel, equipment, products, methods and workmanship.
- Each contractor is responsible for holding the licenses, certifications, registrations and insurance required by the state and locality in which it works, and for applying any pesticide in accordance with its label and applicable law. You are welcome to ask any contractor to show proof of licensing and insurance before work begins.
- The availability of particular services, products, treatment methods and appointment times varies by location and contractor.
- ETAAC Pest Control coordinates the booking, communications and, where applicable, payment for the service, and will help you resolve service issues, but the contractor performs the on-site inspection and treatment.
3. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on ETAAC Pest Control’s Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on the ETAAC Pest Control Site;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by ETAAC Pest Control at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
4. Quotes, Estimates and Pricing
Prices shown on the Site for service packages are “starting at” prices. They represent the minimum price for a typical job of that type and are provided for general guidance. The final price is determined after an on-site inspection and depends on factors such as the type and severity of the infestation, the size and construction of the property, the number of structures or units involved, access conditions, the treatment method required and local market conditions.
- Quotes and estimates given by phone, email or through the contact form are based on the information you provide and are not binding until confirmed after inspection.
- If the inspection shows that the final price will be higher than the amount you prepaid, the contractor or ETAAC Pest Control will explain the difference and obtain your approval before performing additional work. You may decline the additional work; how any prepaid amount is handled in that case is described in our Refund & Cancellation Policy.
- Prices may change without notice, but a change will not affect a booking that you have already confirmed and paid for, except as adjusted following inspection as described above.
- Applicable sales taxes, fees or surcharges, if any, will be shown at checkout or disclosed before work begins.
5. Bookings and Online Payments
The Site uses WooCommerce to let you book and pay for service packages online, including General Pest Control, Termite Inspection & Treatment, Bed Bug Heat Treatment, Rodent Control & Exclusion, Wasp & Hornet Nest Removal, and Dead Animal & Wildlife Removal.
- Order acceptance. Placing an order is an offer to book a service. A booking is accepted when we confirm it, typically by email. We may decline or cancel a booking, with a full refund of any amount paid, if the service is not available in your area, if no contractor is available within a reasonable time, if the order contains a pricing error, or if we suspect fraud.
- Accurate information. You agree to provide complete and accurate information, including the correct service address and a working telephone number, and to update it if it changes.
- Payment processors. Payments are processed by the third-party payment processors available at checkout. By paying, you also agree to the processor’s applicable terms. ETAAC Pest Control does not store complete payment card numbers on the Site.
- Authorization. You represent that you are authorized to use the payment method you provide and authorize us to charge the total amount shown at checkout and any additional amounts you approve after inspection.
- Accounts. If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account.
6. Scheduling and Appointments
Appointment dates and times you choose during booking are requests. We will confirm the appointment, or suggest alternatives, based on contractor availability in your area. Arrival times are usually given as a window rather than an exact time, and may be affected by weather, traffic, emergencies and prior appointments. Some treatments, such as exterior applications, may need to be rescheduled due to rain, wind or temperature. We will make reasonable efforts to notify you promptly of any delay or necessary change. Our office hours are 9AM–6PM; messages received outside those hours will be handled on the next business day.
7. Customer Responsibilities
Successful pest control depends on cooperation between the customer and the technician. You agree to:
- Prepare for treatment. Follow any preparation instructions provided with your booking or by the contractor. For example, bed bug heat treatments typically require removing heat-sensitive items, and general and rodent treatments may require clearing access to baseboards, cabinets, attics, crawl spaces and entry points.
- Provide access. Ensure that an adult (18 or older) is present or that safe access has been arranged, that gates are unlocked, and that all areas to be inspected or treated are reachable. If the technician cannot access the property at the scheduled time, a trip fee or cancellation terms may apply as described in our Refund & Cancellation Policy.
- Protect pets and people. Secure pets during the visit, remove or cover fish tanks and pet food and water bowls as directed, and keep children and pets away from treated areas for the time the technician advises.
- Disclose relevant information. Tell us and the contractor about any known hazards, prior treatments, household members who are pregnant or have allergies, asthma or chemical sensitivities, wells or water sources near treatment areas, and any structural concerns.
- Authority. Confirm that you own the property or have the owner’s or landlord’s permission to authorize the service.
- Follow-up. Follow post-treatment instructions, reduce conditions that attract pests (such as moisture, food sources and clutter), and report continued pest activity within the re-treatment window stated on your booking.
8. Safety
Pesticides and other control products must be applied in accordance with their labels and applicable federal and state law. Contractors are responsible for selecting and applying products appropriately. You should follow all instructions given by the technician regarding re-entry times, ventilation and contact with treated surfaces. Do not attempt to handle stinging insect nests, wildlife or dead animals yourself while waiting for service. If anyone experiences a reaction that may be related to a treatment, seek medical attention and contact Poison Control at 1-800-222-1222 or call 911 in an emergency, then let us know. Technicians may decline or postpone work if conditions on site are unsafe.
9. Cancellations and Refunds
Cancellations, rescheduling, refunds for prepaid bookings, price adjustments after inspection, and re-treatment requests are governed by our Refund & Cancellation Policy, which forms part of these Terms. Please review it before booking.
10. Communications Consent
Our contact and quote form contains the following statement: “By submitting your information, you agree to be contacted about our services, using email, telephone or text message – including the use of auto-dialed and/or pre-recorded calls or messages to the telephone number provided, including your wireless number if provided. I understand that consent is not a condition of purchase.”
By submitting the form, you give that consent under the Telephone Consumer Protection Act and similar laws to ETAAC Pest Control and to contractors acting on your request. You confirm that you are the subscriber or authorized user of the number provided. Consent is not a condition of purchase; you may book by calling (855) 987-5196 instead. You may revoke consent at any time by replying STOP to any text message, telling us during a call, or emailing [email protected]. Message and data rates may apply. We may continue to send messages necessary to complete a booking you have made. See our Privacy Policy for more information.
11. User Content
If you submit messages, reviews, photos, feedback or other content to us (“User Content”), you represent that you own it or have the right to submit it, that it is accurate, and that it does not violate any law or the rights of any person. You grant ETAAC Pest Control a non-exclusive, royalty-free, worldwide license to use, reproduce, display and share your User Content for the purposes of providing and improving our services, including sharing photos and descriptions of a pest problem with the contractor assigned to your job. We will not publish your review or testimonial with your full name without your permission. We may remove any User Content at our discretion.
12. Prohibited Uses
You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- submit false, misleading or fraudulent information, bookings or payment details, or book services in another person’s name without authorization;
- harass, threaten or abuse our staff or contractors;
- attempt to gain unauthorized access to the Site, its administration area, servers or accounts, or interfere with its security features;
- introduce viruses, malware or other harmful code, or overload the Site with automated requests;
- use robots, scrapers, data mining or similar tools to extract content or data from the Site;
- use the Site to send spam or unsolicited communications; or
- impersonate ETAAC Pest Control, a contractor or any other person.
Our security tools may automatically block traffic that appears malicious. We may suspend or terminate access for anyone who violates these Terms.
13. Intellectual Property
The Site and its content, including text, graphics, logos, page layouts and code, are owned by or licensed to ETAAC Pest Control and are protected by copyright, trademark and other laws. Some images are used under third-party licenses, such as images from Wikimedia Commons, and remain subject to their stated licenses. See our Copyright Notice for details and our DMCA Policy to report suspected infringement.
14. Disclaimer
The materials on the ETAAC Pest Control Site are provided “as is.” ETAAC Pest Control makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, ETAAC Pest Control does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Site or otherwise relating to such materials or on any sites linked to this Site.
ETAAC Pest Control claims no credit for any images posted on this Site unless otherwise noted. Images on this Site are copyright to their respective owners. If there is an image appearing on this Site that belongs to you and you do not wish for it to appear on this Site, please contact us with a link to the image and it will be promptly removed.
Pest control results depend on many factors outside anyone’s control, including the biology of the pest, conditions on neighboring properties, and customer preparation and follow-up. Except for any re-treatment terms expressly stated on your booking, we do not guarantee that pests will be eliminated or will not return. Any warranty for workmanship or products is provided by the contractor or manufacturer under its own terms. See our Disclaimer for more information.
15. Limitations
In no event shall ETAAC Pest Control or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ETAAC Pest Control’s Site, even if ETAAC Pest Control or an ETAAC Pest Control authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
To the fullest extent permitted by law, ETAAC Pest Control is not liable for the acts, omissions, workmanship or property damage of independent contractors, and our total liability for any claim relating to a booking shall not exceed the amount you paid to ETAAC Pest Control for that booking. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our own gross negligence, fraud or willful misconduct.
16. Indemnification
You agree to indemnify, defend and hold harmless ETAAC Pest Control and its owners, staff and suppliers from any claims, losses, liabilities, damages, costs and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the Site, your User Content, inaccurate information you provide, or your violation of any law or the rights of a third party.
17. Revisions and Errata
The materials appearing on the ETAAC Pest Control Site could include technical, typographical, or photographic errors. ETAAC Pest Control does not warrant that any of the materials on its Site are accurate, complete, or current. ETAAC Pest Control may make changes to the materials contained on its Site at any time without notice. ETAAC Pest Control does not, however, make any commitment to update the materials.
18. Links
ETAAC Pest Control has not reviewed all of the sites linked to its Site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by ETAAC Pest Control of the site. Use of any such linked website is at the user’s own risk.
19. Dispute Resolution
Informal resolution first. Most concerns can be resolved quickly. Before filing any claim, you agree to contact us at [email protected] or (855) 987-5196 and describe the issue, the booking involved and the resolution you seek. We will work with you, and with the contractor where relevant, in good faith to resolve the matter. If it is not resolved within 30 days after we receive your notice, either party may pursue the remedies available under these Terms.
Venue and small claims. Subject to the informal resolution requirement, any claim relating to the Site or our services shall be brought in the state or federal courts located in [State], and you consent to their jurisdiction, except that either party may bring an individual claim in a small claims court of competent jurisdiction. Where permitted by law, claims must be brought within one year after they arise. Nothing in this section prevents you from contacting a consumer protection agency or your state’s pest control regulatory authority.
20. Site Terms of Use Modifications
ETAAC Pest Control may revise these Terms for its Site at any time. We will update the “Last updated” date at the top of this page and, for material changes, may provide additional notice on the Site. By using this Site you are agreeing to be bound by the then-current version of these Terms. Changes will not apply retroactively to bookings confirmed before the change.
21. Governing Law
Any claim relating to ETAAC Pest Control’s Site or services shall be governed by the laws of the State of [State] without regard to its conflict of law provisions, except to the extent that the consumer protection laws of your state of residence or the state where the service is performed provide otherwise.
22. Severability and General Terms
If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign your rights under these Terms without our consent. These Terms, together with the policies referenced above and the details of your booking, are the entire agreement between you and ETAAC Pest Control regarding their subject matter. Headings are for convenience only.
23. Contact Us
Questions about these Terms may be directed to ETAAC Pest Control by telephone at (855) 987-5196 (9AM–6PM), by email at [email protected], by mail at [Business mailing address], or through our contact page.
